Data protection declaration of the company page of FMC Industrial GmbH on LinkedIn

We welcome you to the company page of FMC Industrial GmbH (hereinafter “FMC Industrial”) on LinkedIn. To provide this company page, we use the technical platform and services of LinkedIn Ireland Unlimited Company (LinkedIn), which is responsible for the operation of the LinkedIn service.

LinkedIn is a social network that, in addition to the creation of private profiles, also enables the creation of company pages. For example, photos, job advertisements and other company information can be uploaded to these pages. Other LinkedIn users have access to this information and can write their own posts or comments and share this content.

In order to give you a good feeling about using the FMC Industrial company page on LinkedIn, we make it transparent for you which personal data we process and, among other things, also provide you with the legally established rights that exist for you in connection with the processing. Personal data is all data that can be related to you personally, e.g. E.g. name, email address or user behavior.

As far as we are able, we also point out the data processing carried out by LinkedIn in the data protection declaration and refer to other sources of information and contact persons. This transparent representation enables an appropriate delineation of the responsibilities of FMC Industrial and LinkedIn in the context of operating the FMC Industrial company page on LinkedIn.

We would like to point out that you use the LinkedIn company page and its functions at your own risk. This applies in particular to the use of interactive functions (e.g. commenting, sharing, rating). Alternatively, you can also access some of the information offered on this page on our company website https://fmc-industrial.de.

1. Responsible body
FMC Industrial and LinkedIn are jointly responsible for data processing on the LinkedIn company page within the meaning of Article 26 of the General Data Protection Regulation (GDPR).

Jointly responsible:
FMC Industrial GmbH
and
LinkedIn Ireland Unlimited Company

For this purpose, LinkedIn has provided FMC Industrial, as the site operator of the LinkedIn company site, with contractual terms and conditions in the form of a Joint Controller Addendum (the “Addendum”), which can be accessed via the following link:
https://legal.linkedin.com/pages-joint-controller-addendum

2. Data protection officer
To protect their rights, anyone affected can contact the data protection officer of FMC Industrial or LinkedIn. Since LinkedIn acts as the primary controller, it is recommended that requests be submitted directly to LinkedIn. If support is needed or other questions arise, you can of course contact FMC Industrial’s data protection officer.

The data protection officer responsible for FMC Industrial, FIDES IT Consultants GmbH, can be reached at the email address datenschutz@fmc-industrial.de.

The data protection officer of LinkedIn Ireland Unlimited Company can be contacted using a form which can be accessed via the following link: https://www.linkedin.com/help/linkedin/ask/TSO-DPO .

3. Information about the processing of personal data by FMC Industrial

FMC Industrial collects and uses personal data on the LinkedIn page within the framework of the requirements of Art. 6 Para. 1 GDPR or if another legal regulation permits processing.

As the operator of the company page on LinkedIn, FMC Industrial receives statistical data (so-called “page insights”) provided by LinkedIn. This data is available in aggregated and anonymized form and does not allow FMC Industrial to draw any conclusions about individual visitors to the company website. FMC Industrial uses the insights data on the basis of Art. 6 Para. 1 lit. f GDPR (legitimate interest) to continuously make the information provided attractive to visitors to the company website and to align it with user interests.

For further information regarding the collection and processing of Insights data by LinkedIn, please refer to the LinkedIn data protection policy (https://de.linkedin.com/legal/privacy-policy?trk=homepage-basic_footer-privacy-policy ).

Visitors to the company website also have the opportunity to use interactive functionalities during their visit, such as the “like” symbol or the comment function. This use usually requires the visitor to register with LinkedIn. When used in this way, personal data and information is visible to FMC Industrial and also to other visitors to the company website and, if necessary, a direct identification of the person can be made. FMC Industrial has no influence on the interactive functionalities and the visibility of user activities on the company website.

We would like to explicitly point out at this point that the company page on LinkedIn can of course also be visited without using these interactive functionalities.

The duration of retention of the data processed by us as part of the operation of the LinkedIn company page is based on the purpose limitation and, if applicable, any existing legal retention periods.

4. Information about the processing of personal data by LinkedIn

LinkedIn processes user data for purposes such as advertising, creating user profiles and generally optimizing the services provided. For this purpose, so-called cookies are used, which are stored on the users’ devices: https://de.linkedin.com/legal/cookie-policy?

What information LinkedIn receives and how it is used is described in LinkedIn’s data protection policy, which can be accessed via the following link: https://de.linkedin.com/legal/privacy-policy?trk=homepage-basic_footer-privacy-policy. LinkedIn has full access to the statistical data resulting from the use of the FMC Industrial company website (so-called “insights”; see also further information in this data protection declaration).

When using LinkedIn services or accessing a LinkedIn page, LinkedIn logs usage data, for example in the form of login data, cookies, device information and IP addresses, which makes it possible for LinkedIn to identify individual users.

If users are currently logged in to LinkedIn, there is a cookie with the personal LinkedIn identifier on the device. This enables LinkedIn to track the access and type of use of LinkedIn. LinkedIn buttons integrated into websites also enable LinkedIn to record visits to these pages and assign them to your personal LinkedIn profile. This data can be used to offer personalized content or advertising.

This can be avoided by logging out of LinkedIn or deactivating the “stay logged in” function, deleting the cookies on the device you are using and closing and restarting the browser. In this way, LinkedIn information that can be used to directly identify the visitor is deleted. This means that FMC Industrial’s LinkedIn company page can be used without revealing your personal LinkedIn ID. When accessing interactive functions (“like” icon, commenting, sharing, etc.), a LinkedIn login mask appears. After you have logged in, you will again be recognized by LinkedIn as a specific visitor.

LinkedIn provides information on possible management of the user account, user data and data protection settings to users under the following link: https://www.linkedin.com/mypreferences/d/categories/account.
FMC Industrial, as the operator of the LinkedIn company page, cannot rule out that LinkedIn transfers user data to third countries and further processes it there (see https://www.linkedin.com/help/linkedin/answer/a1343190 ).

5. The rights of visitors

Users have the right to receive information about the processing of the personal data concerned as well as the information listed in detail in Article 15 GDPR. If the personal data in question is incorrect or incomplete, the correction or completion of this data can be requested (Article 16 GDPR). If one of the reasons listed in Article 17 GDPR applies, you have the right to request the immediate deletion of the personal data. Under the conditions of Art. 18 GDPR, restriction of processing can be requested and in accordance with Art. 20 GDPR, data portability.

Under the conditions of Article 21 GDPR, you have the right to object to the processing of your personal data.

If you believe that the processing of the respective personal data violates the provisions of the GDPR, you can submit a complaint to a supervisory authority, for example the State Commissioner for Data Protection and Freedom of Information in Bremerhaven, as the responsible supervisory authority (Article 77 GDPR).
